AMENDMENT OF TERMS AND CONDITIONS
Acadine Pty Ltd and HR Toolkits reserves the right to amend these terms and conditions of use at any time. Please therefore check these terms and conditions every time you use the hr-toolkits.com.au website and before you proceed to purchase a HR Toolkit or related product from Acadine Pty Ltd.
Payment for HR Toolkits or related products and documents must be effected using PayPal with VISA or Mastercard credit card.
Currency of transaction on the hr-toolkits.com.au site is Australian Dollars (AUD) only. Product pricing includes 10% GST. Users from outside Australia are not required to pay the 10% good and services tax (GST).We reserve the right to amend our prices from time to time.
When you buy a HR Toolkit from Acadine Pty Ltd, you are entitled to one free update in the year in which the toolkit was purchased. This is so that you will have an up to date Toolkit reflecting current trends and content. We will send you a reminder that your free updated HR Toolkit is available with a login and password to collect your updated HR Toolkit.
After purchasing a HR Toolkit or related product such as a HR document or template through the PayPal financial facility on the HR Toolkits website, you will be emailed a link and a password. This link and password will enable you to access the HR Toolkit which is in a .zip file format. Instructions on how to open the .zip file are included in the email. You will be able to download the HR Toolkit for a period of 48 hours via a link in the email. The password for the .zip file will be provided within the email. If you have difficulty in accessing your HR Toolkit or related product you should contact us via ua.moc.stikloot-rh@ofni or via our telephone number, 1300 134 668.
FAIR USE OF HR TOOLKITS
When you purchase a HR Toolkit from the HR Toolkits site it is valid for use by the named purchaser and the organisation that employs the named purchaser. You are not permitted to resell the product or transfer the product to any other company, organisation or third party. All rights reserved. No part of the HR Toolkit may be reproduced or transmitted in any form by means electronic or mechanical without permission granted in writing from HR Toolkits or Acadine Pty Ltd.
In purchasing HR Toolkits you acknowledge that despite our reasonable precautions, our HR Toolkits may be unavailable due to oversight, error, withdrawal or technical difficulties with the website. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged. If in the unlikely occurrence a cancellation of this nature occurs after your credit card has been charged for the purchase, we will immediately arrange a refund for the amount in question or alternatively send the Toolkit as soon as the problem has been rectified if this is within 5 hours of the problem occurring.
Once HR Toolkits are delivered in ‘soft’ copy via the link provided, there is no refund or replacement available unless an error has occurred by HR Toolkits.
LIMITATION OF LIABILITY AND INDEMNITY
To the maximum extent permitted by law, all warranties in relation to the provision of the Toolkits or related documents by HR Toolkits under this agreement, whether express or implied by statute or general law, are excluded and HR Toolkits will not be liable for any loss or damage arising from negligence, where your organisation’s conduct contributed to the damage suffered.
PRIVACY AND SECURITY
The authors believe the information in each HR Toolkit to be accurate and sound at the time it was made publicly available. The information contained in each HR Toolkit is intended as a guide only and is not a substitute for legal advice. Legislation varies from state to state and is subject to change. HR Toolkits is not responsible for any errors or omissions.
GOVERNING LAW AND JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of Victoria which are declared the proper laws of this agreement and the parties hereby submit to the jurisdiction of the courts of Victoria.
We accept no liability for any failure to comply with these terms and conditions where such failure is due to circumstance beyond our reasonable control. If we waive any rights available to us under these terms and conditions on one occasion, this does not means that those rights will automatically be waived on any other occasion. If any of these terms and conditions is held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.
